Kinetic Concepts Inc. scored a legal victory Wednesday in its ongoing battle with Smith & Nephew over the use of Negative Pressure Wound Therapy. A Texas jury sided with KCI in a patent infringement lawsuit.
The lawsuit, filed in the U.S. District Court for the Western District of Texas, alleged that Smith & Nephew infringed on two KCI patents for foam-based NPWT kits. The jury ruled that Smith & Nephew’s RENASYS◊-F Dressing Kit infringes on the patents, and ordered the company to pay damages to KCI. No injunction was filed against Smith & Nephew after the verdict.
Smith & Nephew will continue in its attempt to invalidate KCI’s U.S. patents on foam-based NPWT devices in district court. It already has succeeded in invalidating patents in the United Kingdom and Germany, according to a company release. Smith & Nephew also makes a gauze-based NPWT device, which was not affected by the Texas jury’s decision.
